Terms and conditions applying to access to Jingold Site

This Web site (the “Site”) is owned and run by Jingold – Via F. Turati, 650 – 47522 Cesena (FC).

The information contained in the Site relates to products manufactured and marketed by Jingold and is as complete and relevant as possible. Jingold however reserves the right, at any moment and at its absolute discretion, to make variations to prices, colours, materials, specifications, models or to the availability of those products.

Certain links appearing on the Site may refer the visitor to sites owned and run by third parties. Jingold does not accept any liability in connection with information found on these sites, which is exclusively borne by the owners of the sites in question. Jingold has no control over and/or responsibility for independent Web sites in which it has no proprietary interest and it provides these links to its visitors solely for the purpose of offering them a more convenient service.

1. Intellectual property

All the contents and/or materials found on the Site are the exclusive intellectual property of Jingold. These contents and/or materials cannot be copied and/or reproduced in any manner, apart from when, and to the extent that, such action is necessary to view them on-line. The Site pages may however be printed in their entirety, also on a physical medium, for personal use, provided that the following conditions are met:

(a) no modification is made to the documents and/or associated graphics found on the Site;

(b) the graphics on the Site are not used separately from the corresponding text;

(c) the Jingold copyright and trademark and/or other known marks appear on every copy.

Parts extracted from the Site may not under any circumstances be used, for any purpose, unless in keeping with the conditions set out above. The materials found on the Site and/or its contents have been carefully screened and tested during every stage of production. However, Jingold recommends that up-to-date antivirus software be used. Jingold reserves the right to take legal action before competent judicial authorities in response to any breach of the provisions set out in this paragraph 1.

2. Links to the Web site

If you wish to make a link to the Site available, you must first obtain written approval from Jingold. The link must in any event give access to the Jingold homepage.

3. Access to services

Even though Jingold does all it can to ensure that its Site is available 24 hours a day, it will not in any event be held liable if, for any reason, the Site is not available at any given moment and/or for a specific period of time. Access to the Site may be suspended temporarily, without prior notice, in the event of a system failure, due to maintenance or repair operations, or for reasons beyond Jingold’s reasonable control.

4. Protection of data

We collect and handle your personal data, once you have been registered on our on-line forms, for the purpose for which you subscribed (request for information, services, to receive promotional material, etc.). If you get in touch with us, we can keep track of correspondence exchanged.

We may also send you on-line questionnaires to be completed and then used for market research purposes. Jingold treats the personal data of those visiting the Site as strictly confidential, in keeping with the regulations contained in Legislative Decree no. 196 dated 30th June 2003 (see privacy information notice).

5. Visitors’ material and conduct

Apart from personal data, which will be handled in compliance with legislation dealing with Privacy & Cookies, the contents and/or materials exchanged, and/or transmitted and/or posted on the Site will not be treated as confidential or the property of Jingold, which will therefore have no obligation and/or liability in connection with those contents and/or materials. Jingold and subjects designated by it are at liberty to copy, disclose, distribute, insert and otherwise use these contents and/or materials and/or data and/or images and/or sounds and/or texts and/or other elements contained in them for any purpose.
Visitors may not under any circumstances post and/or exchange and/or transmit to the Site, or from the Site, any material:

(a) which is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, racist, discriminatory, intimidating, scandalous, instigating, blasphemous, that infringes confidentiality or privacy, or that may create disturbance or unease; or

(b) for which you have not obtained all the licences and/or authorisations necessary; or

(c) that constitutes or instigates conduct considered a crime, that gives rise to civil liability, which is otherwise in violation of the law, or infringes the rights of third parties, in any country in the world; or

(d) that is technically damaging (including, for example, but not limited to, computer viruses, logic bombs, Trojan horses, worms, harmful components, tampered data or other harmful software or damaging data).

You must not in any way use the Site in an inappropriate manner, such as, for example, but not only, for hacking activities.

Jingold will give judicial authorities its full collaboration should they request and/or order it to reveal the identity of and/or localise anyone who posts material on the Site that violates the provisions contained in this paragraph and/or relevant legislation currently in force, without prejudice to the right on the part of Jingold to seek compensation for damage.

6. Accuracy of information

Jingold will use its best endeavours to ensure that the contents and materials found on the Site are accurate and up-to-date. However the products described on the site may have characteristics that differ from those most recently specified. We advise customers to check the actual product specifications specifically required with their Jingold dealer when placing an order. Jingold reserves the right to modify product specifications at any time without being held liable in connection therewith.

7. Liability

Jingold and its respective managers, directors, assistants and/or agents do not accept any liability of any kind for any prejudice and/or damage, of any nature, that you and/or third parties may incur (including, for example, but not limited to, direct, consequential or punitive damage, or loss of profit, loss of earnings, goodwill, data, contracts, or loss or damage) in any way stemming from and/or linked to an interruption in operations, and in the event of an unlawful act ( including, for example, but not limited to, negligence, breach of contract or otherwise), resulting from the Site, or from the use and/or the inability to use the Site, or following the use of the Site, of any Web site linked to the Site and/or material contained in it, including, for example, but not limited to, loss and/or damage produced by viruses that may infect your computer or equipment, software, data, and/or other asset after accessing the Site, using and/or surfing on the Site, and/or after downloading material from the Site and/or from linked sites. No provision contained in these conditions will exclude and/or limit liability on the part of Jingold for:

(a) death and/or personal injury caused by negligence on the part of Jingold;

(b) a crime and/or a false, fraudulent statement;

(c) any liability that cannot be excluded and/or limited according to laws applicable.

8. Applicable law and jurisdiction

Any dispute that arises in relation to this Site will be referred to the exclusive jurisdiction of the Court of Forlì and Italian law will be applied.

Privacy

Informative notice served pursuant to art. 13 of Leg. Decree no. 196 dated 30th June 2003

Within the meaning and for the purposes envisaged in art. 13 of Leg. Decree no. 196 dated 30th June 2003 , “Code dealing with the protection of personal data”, it is pointed out as follows:

1. Data supplied by customers, including electronic mail, will be handled, transferred and disseminated, also with the use of electronic or in any event automated media, directly by Jingold and/or through subjects designated or instructed by it and/or by external companies, whether or not they belong to the same Group, for purposes connected with the use of the Site, for statistical purposes, the dispatch of advertising material and the marketing of products and services offered by Jingold and /or its associates.

2. The supply of data by completing the registration form and accepting the conditions for access to the Site constitutes consent on the part of the Customer to the handling of his personal data for purposes connected with the aforementioned access. These data are considered mandatory as they permit effective access to the services requested and the lack or withdrawal of consent may prevent dealings from continuing.

3. The use of data for business purposes (sending out advertising, promotional materials, etc.) is, on the other hand, subject to express consent from the Customer and the lack of such consent will not affect the ability to access the services available on the Site. Whenever Jingold wishes to collect your data for these purposes, the Customer will be requested to give or withhold his consent to the handling in question.

4. The aforementioned data, as well as those processed by the parties, will not be transferred or disseminated in circumstances other than those envisaged by the law and they will be handled in keeping with the principles of propriety, legality and transparency to safeguard the Customer’s privacy and rights.

5. Jingold is the Data Controller, as defined in Leg. Decree no. 196/03, in charge of the handling of personal data, acting through its duly authorised representative pro tempore and is therefore obliged to carry out all the measures envisaged in the said legislation.

The Customer may at any time exercise his rights against the Data Controller, in accordance with art. 7 of Leg. Decree no. 196/2003, which for the sake of clarity, is set out below:

Legislative Decree no. 196/2003:

Art. 7 – Right of access to personal data and other rights

1. The data subject (party concerned) is entitled to obtain confirmation regarding the existence or otherwise of personal data regarding self, even if such data are not yet registered, and to receive the said data in intelligible form.

2. The data subject (party concerned) is entitled to receive information regarding:
a) the origin of the personal data;
b) the purposes for which the data are being handled and the methods adopted;
c) the logics applied in the event that the data are handled with the use of electronic equipment;
d) details identifying the data controller, the data processing supervisors and the appointed representative as envisaged in article 5, paragraph 2;
e) the subjects or the categories of subject to whom the personal data may be transferred or to whose attention they may be brought in a capacity as appointed representative for the territory of the State in question, as data processing supervisors or data processors.

3. The data subject (party concerned) is entitled:
a) to have data revised, altered or, when in his or her interests, supplemented;
b) to have data handled in contravention of the law deleted, rendered anonymous or the circulation thereof restricted, including any information which need not be kept for the purposes for which the data were collected or subsequently handled;
c) to obtain confirmation that the measures referred to in the foregoing paragraphs a) and b), including details thereof, have been brought to the attention of the parties to whom the data have been transferred or disseminated, unless such an obligation proves impossible or would require means which are grossly disproportionate to the rights being protected.

4. The data subject (party concerned) is entitled to oppose, either in whole or in part:
a) upon legitimate grounds, the handling of personal data regarding self, even if such data are relevant, with regard to the purposes underlying the collection thereof;
b) the handling of personal data regarding self for purposes connected with the sending of advertising material, with direct sales, market research or sales communications.

Jingold undertakings to respect your “Privacy”. 5. Tracking and analyses

For the purpose of continually improving communications linked to marketing, Jingold uses “Google Analytics” analytical software from Google Inc. This allows on-line activities to be followed in terms of hour, geographic locations and use of this Site. The information in question is collected via tracking pixels and/or cookies. The information obtained through tracking pixels and/or cookies is anonymous and will not be linked to personal data. All the information necessary for this analysis is stored on servers located in Italy. Jingold does not share this information with third parties for individual use.
